Personally appeared before me, Samuel Wright a Justice of the Peace of said county, Robert Kimball, and being duly sworn on his oath, says: that he saw John Redmund fire twice, once at Near, a soldier, first name not known, saw James OHair senr shoot at Lewis Mullan two or three times. Saw John Frazier shoot at the soldiers. Saw Murphy, first name not known, fire twice at me. Saw a tall, sandy whiskered man, had a shawl on and fur cap, light color, shoot at Near or Mullan, ad further saith not.
